The short version
Be a real student, keep it anonymous, and never target another person. You keep ownership of what you post, and you give us a broad license to run and promote talks. with it. Break the rules and we can remove content or your account. Spanish law governs. How we handle your data is in the Privacy Policy.
These Terms are the agreement between you and the operator of talks., currently its founder, Samer Roz, operating from Madrid, Spain, while the talks. company is being incorporated ("talks.", "we", "us"). They govern your use of the talks. app and website. By creating an account or using talks., you agree to these Terms. Once the company is formed, it will take over as the contracting party and this page will be updated. How we handle your personal data is covered separately in our Privacy Policy.
1. Who can use talks.
You must be a genuine university student and at least 16 years old. Certain features, including Talks Match, require you to be 18 or older. Give accurate signup information, keep your account secure, and stick to one account per person unless we say otherwise.
2. The social contract (acceptable use)
talks. works because everyone follows a simple contract. You agree not to:
- Use or reveal real names or identifying details of any student, faculty, or staff. Your alias is the only identity on talks.
- Target, harass, bully, threaten, or defame anyone. We are here to talk, not to target.
- Dox anyone: no private information, photos, contacts, or locations meant to identify a person.
- Post content that is illegal, hateful, violent, sexually explicit, or that exploits or endangers minors. Child sexual abuse content is reported to the authorities.
- Post spam, scams, or malware, or run bots and scrapers.
- Impersonate another person, alias, or talks. itself.
- Break the law, infringe anyone's rights, attempt to de-anonymize others, or attack our systems.
You are responsible for what you post.
3. Your content and the license you grant us
You keep ownership of what you create on talks. You do not give up your rights to your posts, comments, images, video, or messages.
To run and promote talks., you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual, and irrevocable license to host, store, use, copy, reproduce, adapt, modify, translate, publish, publicly display, distribute, and create derivative works from your content, in any media now known or later developed, for:
- operating, providing, and improving talks. and its features;
- promoting and marketing talks. (for example, featuring posts on our site, social channels, or ads); and
- analysing and developing our products, including training and improving the automated systems that run, rank, and moderate talks.
This lets us keep showing content after you leave, and lets our providers display it on our behalf. It ends for new uses when you delete content or your account, except that copies may persist in backups for a limited time, content others reposted may remain, and we may retain content where the law or safety requires. You confirm you have the rights to everything you post.
4. Anonymity and moderation
We keep talks. pseudonymous: we verify emails but do not link them to your posts publicly, and only connect an alias to a person where the law compels us or to stop a serious safety threat. Moderation is community-first: users report content, reports above a threshold send content into review, and moderators can remove content, withhold media that fails automated safety scans, suspend features, or terminate accounts. We do not guarantee every item is reviewed and are not liable for user content, but we may remove anything that breaks these Terms.
5. Suspension and termination
We may suspend or terminate your access, remove content, or restrict features if you break these Terms, if the law requires it, or to protect users or the service. You can delete your account any time in Settings; what deletion erases and retains is in the Privacy Policy. Banned users may be prevented from creating new accounts.
6. Our content and brand
talks., its name, the penguin avatars, cosmetics, design, and code are owned by us or our licensors. These Terms give you no right to use our brand except as part of normal use. Culture score, cosmetics, and aliases have no cash value, are not your property, are not transferable for money, and may change or be removed.
7. Disclaimers
talks. is provided "as is" and "as available." We do not promise it will be uninterrupted or error-free, or that user content is accurate or reliable. Content is created by users and does not represent our views. Nothing here excludes liability that cannot be excluded under Spanish law, including your consumer rights.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, reputation, or opportunity, arising from your use of talks. or from other users' conduct or content. Nothing limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited under applicable law.
9. Changes
We may update these Terms. If a change is material, we will give reasonable notice, for example in the app. Continuing to use talks. after a change means you accept it.
10. Governing law and disputes
These Terms are governed by Spanish law. Disputes are subject to the courts of Madrid, Spain, except that consumers keep the protection of the mandatory laws and competent courts of their EU place of residence.
